DISCLAIMER FOR RESERVATION TERMS AND CONDITIONS
By submitting payment, authorizing payment, accepting a reservation, traveling, or otherwise participating in any travel arrangements made through Cruiser Travels, LLC (“Cruiser Travels”), you acknowledge that you have read, understand, and agree to these Terms and Conditions, as well as the terms and conditions of all cruise lines, airlines, hotels, resorts, tour operators, transportation companies, travel insurance providers, and other travel suppliers involved in your reservation (“Suppliers”).
Cruiser Travels acts solely as an independent travel agency and intermediary between travelers and Suppliers. Cruiser Travels does not own, control, manage, operate, or provide the travel services purchased. All transportation, accommodations, cruises, excursions, insurance products, and other travel services are provided solely by the applicable Supplier. As such, Cruiser Travels shall not be responsible for the acts, omissions, negligence, bankruptcy, insolvency, cancellation, delay, schedule change, overbooking, labor dispute, mechanical failure, injury, illness, death, property damage, service failure, or other actions of any Supplier.
All reservations are subject to the Supplier’s terms and conditions, which may be amended by the Supplier at any time. Travelers are responsible for reviewing and complying with all Supplier requirements, policies, restrictions, cancellation penalties, health requirements, travel documentation requirements, and other conditions of travel. Continued participation in a reservation constitutes acceptance of all Supplier terms and conditions.
Travelers are solely responsible for obtaining and carrying all required travel documents, including but not limited to passports, visas, government-issued identification, vaccination records, health certificates, entry permits, transit permits, and any other documentation required by governmental authorities or Suppliers. Cruiser Travels shall not be responsible for denied boarding, denied entry, missed embarkation, missed flights, delays, additional expenses, penalties, cancellations, or losses resulting from missing, invalid, damaged, incorrect, or expired travel documents.
Travel requirements, health requirements, entry requirements, vaccination requirements, testing requirements, customs requirements, and immigration requirements may change without notice. Travelers are solely responsible for monitoring and complying with all applicable requirements before and during travel. Cruiser Travels does not guarantee the accuracy or continued validity of any governmental or Supplier requirements communicated at the time of booking.
Travelers are responsible for carefully reviewing all invoices, confirmations, itineraries, passenger information, pricing, travel dates, promotions, and reservation details immediately upon receipt. Any discrepancy, error, omission, or concern must be reported to Cruiser Travels within twenty-four (24) hours of receipt. If no notification is received within twenty-four (24) hours, the reservation details shall be deemed accepted and approved by the traveler. Cruiser Travels shall not be responsible for losses, penalties, supplier fees, denied boarding, or additional expenses resulting from errors not timely reported.
Cruiser Travels reserves the right to correct typographical errors, pricing errors, commission errors, promotional errors, supplier errors, data-entry errors, and system errors. In the event an error is discovered, Cruiser Travels may revise pricing, modify reservation details, or cancel a reservation if necessary to correct the error. If a corrected price is unacceptable to the traveler, the traveler may cancel subject to applicable Supplier policies.
Unless otherwise stated in writing, all deposits are non-refundable. Supplier cancellation penalties may begin immediately upon booking and may increase as the departure date approaches. Final payment dates are provided as a courtesy; however, travelers remain solely responsible for ensuring all payments are made by Supplier deadlines. Cruiser Travels does not automatically process final payments unless expressly authorized to do so. Failure to make timely payment may result in cancellation, loss of deposits, loss of promotional amenities, increased pricing, Supplier penalties, or complete forfeiture of the reservation.
Travelers are responsible for verifying that all payments have been successfully approved and processed by both their financial institution and the Supplier. Cruiser Travels shall not be responsible for cancellations, penalties, loss of reservations, loss of amenities, increased pricing, or other damages resulting from declined credit cards, insufficient funds, fraud-prevention holds, payment reversals, processing errors, banking issues, or other payment-related failures.
Cruiser Travels is committed to protecting its customers from fraud and unauthorized payment activity. Cruiser Travels acts solely as an intermediary between travelers and travel Suppliers and does not collect or maintain customer funds for travel purchases.
For the protection of our customers, Cruiser Travels does not accept payments through PayPal, Zelle, Venmo, Cash App, wire transfers, cryptocurrency, personal bank accounts, personal payment accounts, or similar money transfer services. Cruiser Travels will never instruct a traveler to send money to an individual person, employee, contractor, manager, personal account, third-party payment account, or private payment service.
The only payment method accepted for travel reservations through Cruiser Travels is a valid credit card or other payment method processed directly through the applicable travel Supplier. In most cases, charges will appear on the traveler’s credit card statement under the name of the cruise line, airline, hotel, resort, travel insurance provider, tour operator, or other travel Supplier and not under the name “Cruiser Travels.”
Travelers acknowledge that if they receive instructions from any person claiming to represent Cruiser Travels directing them to send money through PayPal, Zelle, Venmo, Cash App, cryptocurrency, personal bank accounts, or similar payment services, such instructions should be treated as suspicious and immediately reported to Cruiser Travels before any funds are transmitted.
Travelers are responsible for reviewing their invoices, confirmations, payment receipts, and credit card statements and for promptly reporting any unauthorized, suspicious, unexpected, or inconsistent payment requests or transactions.
Cruiser Travels reserves the right to verify payment information and customer identities for fraud prevention and security purposes. Cruiser Travels will cooperate with law enforcement authorities, financial institutions, travel Suppliers, and fraud investigators in the investigation of suspected fraudulent activity.
The purpose of this policy is to protect travelers from fraud and to ensure that all reservation payments are processed through secure and authorized Supplier payment channels.
Cruiser Travels strongly recommends the purchase of travel insurance. Travel insurance is not included unless specifically purchased and listed on the traveler’s invoice. If travel insurance is declined, the traveler acknowledges that coverage for trip cancellation, trip interruption, medical expenses, emergency evacuation, baggage loss, travel delays, and other travel-related losses may not be available. The traveler further acknowledges that they were offered the opportunity to purchase travel insurance and voluntarily declined such coverage.
Cruiser Travels may offer promotional amenities, onboard credits, specialty dining, beverage packages, internet packages, gift cards, prepaid gratuities, excursions, or other incentives in connection with a reservation. Travelers acknowledge that such incentives may be modified, reduced, substituted, or removed if a reservation is repriced, transferred, modified, upgraded, downgraded, cancelled, refared, or otherwise altered by the traveler or Supplier.
Cruiser Travels relies exclusively upon information, descriptions, deck plans, photographs, renderings, virtual tours, videos, marketing materials, and representations provided by Suppliers and other third parties. Cruiser Travels does not independently inspect, verify, measure, certify, or guarantee the accuracy of any cabin, stateroom, hotel room, suite, balcony, view, accommodation, amenity, furnishing, bedding configuration, square footage, accessibility feature, location, or other accommodation-related information.
Photographs, renderings, floor plans, virtual tours, and promotional materials are provided for illustrative purposes only and may not accurately depict the specific accommodation assigned to a traveler. Actual accommodations may differ in appearance, layout, size, furnishings, condition, view, balcony configuration, accessibility, proximity to elevators or public areas, noise levels, and other characteristics.
Travelers acknowledge that certain cabins, staterooms, hotel rooms, balconies, and accommodations may have partially obstructed, substantially obstructed, or otherwise limited views due to ship design, lifeboats, tenders, structural supports, maintenance equipment, railings, public areas, construction features, temporary installations, operational requirements, or other conditions. In some circumstances, such obstructions or limitations may exist even when not specifically identified or disclosed by the Supplier.
Cruiser Travels does not warrant or guarantee unobstructed views, specific locations, particular deck placements, quiet surroundings, cabin configurations, bedding arrangements, accessibility features, room dimensions, balcony dimensions, or any accommodation characteristic beyond the category purchased and confirmed by the Supplier.
If a traveler has specific accommodation requirements, preferences, concerns, or expectations, including but not limited to unobstructed views, proximity preferences, accessibility needs, bedding configurations, noise concerns, or location preferences, the traveler must notify Cruiser Travels prior to booking. Cruiser Travels will make reasonable efforts to communicate such requests to the Supplier; however, all accommodations and assignments remain subject to Supplier availability, policies, and discretion.
If a traveler is dissatisfied with any accommodation assigned by a Supplier, Cruiser Travels may, as a courtesy, assist the traveler in communicating concerns to the Supplier and requesting consideration, relocation, compensation, or other remedies. However, Cruiser Travels cannot guarantee any particular outcome and shall not be responsible for accommodations that do not meet a traveler’s subjective expectations or preferences.
Cruiser Travels shall not be liable for any refunds, credits, compensation, damages, inconvenience, disappointment, loss of enjoyment, emotional distress, or other claims arising from accommodation assignments, cabin locations, views, obstructions, room conditions, room size, room configuration, accessibility limitations, noise levels, Supplier representations, or any other accommodation-related matter.
Many Suppliers permit travelers to directly access, modify, cancel, reprice, transfer, upgrade, downgrade, add airfare, remove airfare, or otherwise alter reservations without the involvement of Cruiser Travels. Travelers agree to promptly notify Cruiser Travels of any direct communication or transaction with a Supplier that affects a reservation. Cruiser Travels shall not be responsible for any pricing discrepancies, lost promotional benefits, lost amenities, lost group benefits, commission recalls, Supplier penalties, airfare issues, booking errors, administrative expenses, or other losses resulting from modifications made directly with a Supplier without Cruiser Travels’ knowledge or involvement.
Airfare, transportation, and other Supplier-controlled services are subject entirely to Supplier policies and procedures. Cruiser Travels does not control airline schedules, airfare programs, seat assignments, schedule changes, cancellations, airport operations, transportation interruptions, or Supplier communications. Travelers remain responsible for monitoring all airline reservations, transportation arrangements, and travel schedules and for promptly reporting any concerns or discrepancies.
If a traveler directly modifies a reservation, provides inaccurate information, initiates an unauthorized chargeback, submits a fraudulent claim, reverses a valid payment, misrepresents material facts, or otherwise causes financial loss, penalties, administrative expenses, collection costs, legal expenses, or damages to Cruiser Travels, the traveler agrees to reimburse Cruiser Travels for such amounts to the fullest extent permitted by law. Cruiser Travels reserves all legal and equitable remedies available for recovery.
Travelers agree to contact Cruiser Travels prior to initiating any credit card dispute, chargeback, payment reversal, or similar claim. If Cruiser Travels successfully defends such dispute or if the dispute is determined to be inconsistent with these Terms and Conditions, the traveler agrees to reimburse Cruiser Travels for reasonable administrative costs, collection costs, court costs, filing fees, and attorneys’ fees where permitted by law.
Travel involves inherent risks that are beyond the control of Cruiser Travels. Such risks may include illness, injury, accidents, crime, transportation disruptions, weather events, political instability, civil unrest, acts of terrorism, mechanical failures, labor disputes, governmental actions, public health emergencies, and other unforeseen events. By participating in travel, travelers voluntarily assume all such risks.
Cruiser Travels shall not be liable for any delay, cancellation, loss, injury, death, inconvenience, expense, or damage arising from circumstances beyond its control, including but not limited to acts of God, hurricanes, storms, floods, earthquakes, fires, pandemics, epidemics, disease outbreaks, government actions, war, terrorism, civil unrest, labor disputes, transportation interruptions, port closures, mechanical failures, Supplier insolvency, or any other force majeure event.
To the fullest extent permitted by law, Cruiser Travels shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, emotional distress, or economic damages arising from or related to any reservation or travel services arranged through Cruiser Travels. In no event shall Cruiser Travels’ total liability exceed the amount of commission actually received by Cruiser Travels for the reservation giving rise to the claim.
The traveler agrees to indemnify, defend, and hold harmless Cruiser Travels and its owners, officers, employees, agents, contractors, affiliates, successors, and assigns from and against any claims, demands, liabilities, damages, losses, penalties, costs, and expenses, including reasonable attorneys’ fees, arising from the traveler’s actions, omissions, negligence, violation of Supplier policies, violation of law, provision of inaccurate information, or breach of these Terms and Conditions.
Travelers consent to receive communications from Cruiser Travels via email, telephone, text message, and other electronic means regarding reservations, travel updates, payment reminders, and service-related matters. Electronic communications and electronic records shall be deemed acceptable evidence of communications and agreements between the parties.
Cruiser Travels’ standard business hours are Monday through Friday from 9:00 a.m. to 6:00 p.m. Eastern Time, excluding major holidays. Requests received outside normal business hours may not be reviewed until the next business day unless prior arrangements have been made.
Unless otherwise disclosed, payments are processed directly by the applicable Supplier and may appear under the Supplier’s name on bank or credit card statements. Cruiser Travels does not accept responsibility for Supplier merchant processing practices or Supplier billing descriptions.
These Terms and Conditions shall be governed by and construed under the laws of the State of Maryland, without regard to conflict-of-law principles. Any legal action arising from or relating to these Terms and Conditions or any reservation arranged by Cruiser Travels shall be brought exclusively in the state or federal courts located in Maryland, and the parties consent to the jurisdiction of such courts.
If any provision of these Terms and Conditions is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
By authorizing payment, accepting a reservation, traveling, or otherwise participating in any reservation arranged by Cruiser Travels, the traveler acknowledges that they have read, understand, and agree to these Terms and Conditions.
